Hello! I am Gobby. I am a self-taught artist from Los Angeles, I work mostly in digital art but I have been known to work in physical media. Terms of Service
These are the terms of service for Gobby the Bedroom Goblin (also referred to as “the artist,” “I,” “me,” and “myself”)In contacting and agreeing to receive artwork from me, the client (also referred to as “you” and “your”) enters a contract with me and agrees to all the terms on this page.The client also affirms that they are at least 18 years old in contacting and agreeing to receive artwork from me. If it is discovered that you are under the age of 18 when trying to commission me, I reserve the right to block you on my social media until you meet the minimum age requirement.If you have any questions, please contact me at [email protected]CLIENT’S RIGHTS AND OBLIGATIONS:1. It’s your obligation as a client that reaches out to get a commission from me to read these Terms of Service and to proceed with the commission process only after having done so and having agreed to them.2. As a client, you might request sketches/proofs of concept/process pictures at any point after you've paid.3. As a client, you might request changes to the design at any point in time after you've paid at least full or half (depending on the amount); however, if I deemed said change a sufficient increase in my workload, an extra fee will apply. In the said case, a modification to the original price will be made and a new payment will be required.4. You may re-post an image from me with proper credit and do not claim it as your art! i.e. tag me, put my @ in the description, or add my social media to your website, etc.5. You can use your commissioned art as decoration for your social media if it's a personal account and you're NOT making any profit from it. (If you want to profit from it check my commercial section down below)6. The responsibility is for you to ensure your order contains the details you want me to follow. Or if you request for me to make a design for you, there may be a design fee depending on complexity.ARTIST’S RIGHTS AND OBLIGATIONS:1. I may decline commission depending on available slots, the content of commissions, or other reasons.2. I reserve the right to decline further commissions or request the removal of any commissions that are not in compliance with my terms.3. I own the Artwork, so I may do whatever I wish with the art, for example, posting it to other sites such as Instagram, Twitter, and Patreon. Or present it in future art books/ Portfolios etc. But always with proper credit to you!4. If a commissioner repeatedly commissions me but, in the end, always cancels the order, I will consider you a timewaster and blacklist you.5. Individual slots will not be taken until I have confirmed details with the client and have decided to take on the project.ABOUT ORDERING AND PAYMENT/PRICING:1. All prices are in USD.2. I do not mint or sell the commissioned work for NFT, cryptocurrency, or anything that is similar in the future.3. After sending your order to me and discussing the price I will send an invoice through PayPal to you. The high-quality zip file will be sent to you via email once it's finished and I received the full payment.4. Once you have received your invoice, you are expected to pay within a one-week grace period. but still following the rules below. If payment is not made in a timely manner, the commission will be canceled on the spot.
a. Additional time will be allowed in the event of circumstances beyond the client's control.5. Any commission that is $100 USD and below, must be paid in full.6. Any commission that is $100 USD and above, must be paid 50% upfront and 50% when the art is finished.7. If you require rush order, it will be at least an at least an additional 50% of the total commission price (it will depend on complexity) but I will discuss with you if it is possible to do your order rushed.8. Tips are not mandatory but immensely appreciated!Work Speed:1. I will try to finish your Commission as fast as I can, however, please be patient with me.2. I will try to finish your commission between 2-4 weeks after we talk but it may take longer, it depends on my to-do list and motivation3. Check my Commission List whenever you want a status update4. The maximum you'll have to wait is 2-3 months (In the worse case, which is not usual but may happen)5. I tend to work when I feel most motivated so that your commission is done properly and with the best effort.6. I'll always inform you if something comes up and there is a delay with the art.REPRODUCING AND SELLING ARTWORK/RIGHTS:1. All commissioned pieces unless specified, are for personal use only. You cannot use my commissions for merchandise or resale without my consent. Do not reproduce, redistribute, or resell my work without my permission.
a. There is a 150% - 300% higher cost of the price of other artwork if you are interested in buying the commercial rights to sell as merchandise. (Prints, keychains, mugs, etc.)2. Credit me as your artist in a place where it is visible and easily accessible. i.e. product description, website description, Instagram description or full post, etc.3. Do not claim my work as your own.4. I have the right to post partial or complete depictions of the work I produce for clients on social media on a smaller canvas size or lower resolution than the original whenever possible, as well as using said artwork under my discretion for exposure purposes only. I'm not allowed to commercialize the client’s I.P. or claim it as my own.5. In case a character design is requested, the I.P. of said design will be created by me, under the client's directions, and will be transferred to them once the final payment goes through. The client will then own the I.P. of the character but will still need to credit me as the artist.6. You may not alter the art itself.7. You retain the rights to the characters featured in the commissioned artwork and have the right to use your commissioned art for any personal usage (outside of commercial usage; see point above). This does not mean you own the copyright to the image.8. Commissioner cannot post the drawing publicly without my watermark or signature.9. I require credit to be clearly written in an easy-to-see place. This should be in your bio and about pageCHANGES IN YOUR COMMISSION/ REVISIONS AND SPECIFICATIONS:1. Once the picture is finished, I can do small changes such as color adjustments and/or adding tiny details I may have forgotten. (i.e., I missed a detail that you had provided in the order)2. Any great changes will come with an extra charge such as poses, outfit change, outfit addition or subtraction, background change, or anything that makes me must redraw it completely.3. I will send process images on each completed stage of the commission (rough sketch/ color blocking, clean sketch, lines, etc.) to make sure there are no corrections needed. You can check Trello where all my commissions are and at which stage they are at. (You can also look at my carrd to see my process)4. The client will be given the opportunity to direct any sort of revisions during the sketching stages.5. Fees may apply if the changes become too frequent and/or diverge from the original description and idea given.6. If there are corrections needed after the sketched portion of the image, additional fees may apply. This includes major revisions after the work is completed.
a. Major revisions include, but are not limited to changes to the positions of the limbs and/or torso, adding new clothing, significant changes.REFUND RULES/CANCELLATION AND REFUNDS:1. A 95% refund is available if you have paid the invoice, and the canceled commission has not been started. I retain 5% of the payment as a convenience fee.2. 50% refunds are available for canceled commissions that have been started but not completed.3. If I am the one to cancel the commission, 95% of the payment will be refunded to the client at any point in the process.4. Completed art NO REFUNDS5. I can cancel and refund a commission for reasons including, but not limited to: Rude or inappropriate behavior, poor communication, or a failure to communicate in effective English, or an unforeseen inability to complete the commission.6. When a commission is canceled before it is complete, the client may keep the incomplete art. I still hold the copyright to the art. The unfinished art may not be altered or completed by another artist.

Step by step
A guide on the commission process!1. Contact me!
Contact me through the google form and I'll reply as soon as possible, this may take a few days. I am just making sure your commission follows my T.O.S. and that I can fulfill it.2. Discussion
We will discuss the commission such as budget, vision, and any specifics about the commission you did not put in the google form. No such thing as too much information in this step.I'll make a reference board using your reference images that refine the ideas better.3. Rough Sketch and color blocking
I'll make a rough sketch using the reference board. I'll try some different poses and concepts if we have several ideas. This includes color blocking.You can take some time to think about it before completely committing to the idea and commission project with me4. Detailed Sketch
At this point, I'll ask for payment (look at TOS for how much you'll be paying) to ensure you are committed to this project. I'll use the email address provided in the google forms and send you an invoice.I'll make a cleaner more detailed sketch of the concept art you've decided on. Please make note of any modifications to the design as you need either before or during this part of the process. Subsequent changes might cost extra after this point.5. Linework/Ink
Once payment has gone through and the sketch has been approved of I'll start inking the piece. You'll receive a preview of the inked linework to review and approve of once again, before moving to the last stages of the commission.Please make note of any modifications to the design as you need either before or during this part of the process. Changes to the linework might cost extra after this point.6. Coloring
After the linework is complete and approved, I'll start coloring your piece. By this point I should have been provided with a color palette, and will ask for one in the case I haven't - you can either send pictures of specific colors and hues you like or describe them to me as best you can. I might send a couple of color versions for you to choose from in that case.Please make note of any modifications to the design as you need either before or during this part of the process. Changes to the coloring might cost extra after this point.7. Final Review
Once I consider the piece to be complete I'll send a smaller version of it as a preview for you to review and approve of.If you love the piece you'll pay the rest for the invoice (if applicable), and once that goes through I will provide you with the original illustration (including color variants if any, copies of artwork with no background, etc.) by email in a zip file.If the finished piece were to need any small adjustments (that would take up to 15 minutes of my time to correct) they fall under the grace period of the time you've paid me for up to the point, but if I were to deem any changes as substantial enough to require extra compensation. Another invoice will be sent with a mutually agreed-upon price and the edited piece will be sent upon completion as long as the payment has gone through.
